Agreement to Terms

By downloading, installing, accessing, or using any software product or service provided by Cherrium LLC, you agree to be bound by these Terms of Use. If you do not agree to these Terms, you must not install or use the software.

1) Service Description

These Terms govern your use of software products and services provided by Cherrium LLC, including but not limited to Peek, Flow, Harbor, CinePlan, and digital sticker products. Certain features may analyze, process, or store user-submitted or user-generated content only when explicitly activated by the user.

2) AI Output Disclaimer

AI-generated output may be inaccurate, incomplete, outdated, biased, or unsuitable for your use case. You are responsible for reviewing and validating all output before relying on it. Cherrium software is not medical, legal, financial, or safety-critical advice software.

3) Acceptable Use

  • No unlawful activity or policy violations.
  • No infringement of intellectual property, privacy, or confidentiality rights.
  • No malware, phishing, abuse, harassment, or harmful content.
  • No reverse engineering, scraping, or misuse of service infrastructure.

4) Subscriptions and Billing

Certain software products may offer auto-renewing subscriptions handled by Apple In-App Purchase or other authorized platforms.

  • Payment is charged to your platform account.
  • Subscriptions renew automatically unless canceled before renewal.
  • You may manage or cancel subscriptions within your platform account settings.
  • Restore Purchases may be available in supported apps.

5) Privacy and Data Handling

Cherrium software may transmit or store user-submitted content or feature-related data to third-party infrastructure to provide functionality. Cherrium LLC does not sell personal data.

6) No Warranties

To the maximum extent permitted by law, Cherrium software is provided “as is” and “as available,” without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or availability.

7) Limitation of Liability

To the maximum extent permitted by law, Cherrium LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, business interruption, data recovery costs, goodwill, or business opportunities arising out of or relating to the use of any Cherrium software product. To the extent liability cannot be excluded under applicable law, Cherrium LLC’s total liability arising out of or relating to the software shall not exceed the amount paid by the user for the applicable product in the twelve (12) months preceding the claim. Your sole and exclusive remedy is to discontinue use of the software and, where applicable, seek a refund through the platform provider.

8) Product-Specific Terms

Peek by Cherrium

Peek is an AI-powered utility that allows users to submit prompts and receive AI-generated responses. Users are responsible for ensuring they have the right to disclose any content processed by Peek.

Flow by Cherrium

Flow is a macOS utility that enables dynamic wallpaper functionality. Users are responsible for ensuring they have the rights to use any media files loaded into Flow.

Harbor by Cherrium

Harbor is a backup and archival utility designed to help users securely store and manage their own data. Users are solely responsible for maintaining appropriate backups and verifying the integrity of their stored data. Harbor should not be relied upon as the sole backup solution for critical data. Cherrium LLC does not guarantee prevention of data loss.

CinePlan

CinePlan is a web-based planning and production tool provided by Cherrium LLC, available at https://cineplan.cherrium.com. Users are responsible for ensuring they have the rights to upload, enter, or share any data used with CinePlan, and for reviewing outputs, schedules, or planning information before relying on them.

Zoruh Stickers

Zoruh Stickers are static digital sticker packs intended for use within supported messaging platforms. Redistribution, resale, extraction, or unauthorized reproduction is prohibited.

Zoruh Stickers Animated

Zoruh Stickers Animated are animated digital sticker packs intended for use within supported messaging platforms. Users may not extract, modify, redistribute, sublicense, or resell animated assets outside their intended platform use.

9) Arbitration and Class Action Waiver

To the extent permitted by applicable law, any dispute arising out of or relating to these Terms or the use of Cherrium software shall be resolved through binding arbitration rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. The arbitration will be administered by the American Arbitration Association (AAA) under its applicable rules. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of any class, consolidated, or representative action. These Terms are governed by the laws of the State of Maine, without regard to conflict of law principles.
